I. General Provisions

1. Scope/Terms

These Terms of Use, as published at the time of entering into a contract, govern the use of and orders for any and all services offered via www.talentspotting.com (the “Website”) in connection with our Talentspotting Recommendation Platform (the “Platform” or “Talentspotting”) as agreed between Brainspotting Consulting SRL, 6 Pitar Mos Str, Bucharest, Romania, and our customers (hereinafter referred to as “Customers”). Other terms and conditions as imposed by the Customer will only be recognised if they bear the signature of Brainspotting Consulting SRL.

The services we offer are strictly addressed to enterprises. For the purpose of these Terms of Use, we do not enter into contracts with consumers – natural persons.

The Customer shall be deemed represented by the persons opening and managing an online account on www.talentspotting.com (hereinafter the “Administrator”, “Administrators”). Administrators shall at the same time act as contact persons for Brainspotting Consulting SRL in managing the contract.

2. Later Amendments of these Terms of Use

Brainspotting Consulting SRL is entitled to adjust and complement these Terms of Use governing existing business relations to the extent that this is required due to changes in legislation or due to court rulings, or if other circumstances arise as would cause a more than insignificant imbalance in contractual relations. Such later amendments of these Terms of Use will take effect if the Customer does not object thereto within six (6) weeks from notification of the change. Brainspotting Consulting SRL will expressly indicate to the Customer at the beginning of such period for objection that tacit consent results in the acceptance of the contractual change and will give the Customer an opportunity for an express declaration of intent during such period. If the Customer objects within the deadline, both Brainspotting Consulting SRL and the Customer shall be entitled to immediate termination of the contractual relationship.

II. Conclusion of Contract and Subject Matter of Contract

1. Conclusion of Contract

By registering a business account via www.talentspotting.com (“Customer Account”), the Customer accepts these Terms of Use and enters into a contract for the use of the services provided on the platform and pays the corresponding fees (‘Talentspotting Contract’). Brainspotting Consulting SRL accepts this offer to enter into a contract by activating the Customer Account and signing a contract with us.

2. Subject Matter of Contract

The subject matter of the contract is the provision of access to the platform offering chargeable services for a defined term, as described below and in Section III in more detail.

Upon registration, the Customer will choose a Talentspotting domain (for example: ‘[Name of Customer].talentspotting.com‘). Brainspotting Consulting SRL reserves the right to block certain domain names and/or change them (on reasonable grounds).

The use of the platform is chargeable, as described in the Talentspotting contract signed by each Customer. The use of such Chargeable Services shall also be governed by these General Terms and Conditions of Business. Prior to entering into a contract for Chargeable Services, Brainspotting Consulting SRL will inform the Customer about the content of each Chargeable Service, prices and payment terms.

Customer shall keep the password for access to the private area strictly confidential and shall refrain from disclosing it to third parties. Customer will take appropriate

We are Talentspotting – the online referral tool and ATS used by your Employer or the Company with whom you are seeking employment at https://talentspotting.com/ and its Customers’ subdomains on Talentspotting – e.g. https://companyname.talentspotting.com .

The operator of the Talentspotting website, Brainspotting Consulting S.R.L., registered in Romania, with Company Registration Number RO 29630772 and having its registered office address at 6 Pitar Mos Street, Room no. 1, 4th Floor, 1st District, Bucharest ("We", "Us", “Talentspotting”) is committed to protecting your personal data .

Who does it apply to?

This Privacy Policy applies to the personal data of all our Website Users (logged-in or unregistered), Customers and Suppliers.

Website Users are defined as any and all individuals who access Talentspotting or our Customers’ Subdomains on Talentspotting, either while they are logged into or not logged into their Talentspotting accounts.

Logged-in Website Users are defined as follows:

  • A Customer representative in HR/Recruitment/Marketing who has been given the rights of an Administrator;
  • A Recommender who has been added to a Customer account by Customer representatives;
  • A Candidate – who has been recommended for a job or has applied for a job independently or has simply created an account on Talentspotting;

Customers are defined as our customers, clients, and others to whom Talentspotting provides services in the course of its business.

What personal data processing do we perform, what is the purpose of processing, the legal basis, the storage period and the potential data transfer?

We limit the personal information we collect about you to that which is necessary for us to provide the services of our business.

We collect and/or obtain your name, surname, phone number, e-mail address, information about your professional background, information about the use of our website, IP address, and any additional information you provide in your Curriculum Vitae (”CV”) and during our collaboration.

In the following we provide you with all the necessary information regarding the type of data we collect/obtain, the purpose of processing, legal basis, storage period, potential data transfer, for a better understanding.

How do we collect information from you?

Depending on your role in our relationship with us, we collect information from you directly or from other sources.

    • Information that you provide by filling in forms on each of our Customers’ subdomains on the Talentspotting.com website (“Website”). This includes information provided at the time of registering to use the Website, either by manual account creation or by logging in with your existing Facebook, LinkedIn or Google account, or by requesting further information or support.
    • If you contact Us, We may keep a record of that correspondence.
    • We may also ask you to complete surveys that We use for research purposes, although you are under no obligation to respond to them.
    • Details of all actions that you carry out through the Website and of the provision of services to you.
    • Details of your visits to the Website including, but not limited to, traffic data, IP, weblogs and other communication data, the site and/or the person that referred you to our site and the resources that you access, technical information, information about what type of device you use to connect to our website, how you interact with our website.     • When you register to use our Services you will be required to provide your full name and e-mail address and/or your place of work on the subdomain of the company that you work for or wish to apply to. We will inform you whether you are required to provide information to us at the point of collecting information from you.

    • names and contact details of Customer personnel who will be added as account members for the Customer’s account;
    • names and contact details of individual contacts at prospective Customers from public sources, such as social networks, company websites and other online sources. As part of the service We provide, or for legal reasons, we may receive information about you from third party partners or subcontractors we work with.

Where do we store your personal data or who do we share your personal information with?

We do not sell personal information to anyone and only share it with third parties who are facilitating the delivery of Talentspotting services. We disclose your personal information to other partners and third parties (clients and sub-contractors) only to the extent necessary to run our business, fulfil any contracts we enter into with you, where required by law or to enforce our legal rights.

We may share your personal data with:

  • Processors, such as certain service providers (e.g. technology platform provider, data processing suppliers, IT services providers, website hosting and administrator, external consultants and suppliers, data analysis providers, cloud-based infrastructure suppliers, professional services independent contractors such as auditors, accountants, lawyers) that are our sub-contractors who provide us support in relation to the services we run or who process the information on our behalf. These data processors use your data only how we instruct them to do it and they will not share your personal information with any organisation apart from us. They will hold it securely and retain it for the period we instruct.
  • Authorities, as required by law (e.g. audits, investigations, litigation).
  • In case we transfer all or part our business to another company, your personal information will be transferred along with the other assets of Talentspotting to the subsequent third party and usage of your personal information will continue to be done in line with this privacy policy.

Your personal data are stored by our hosting service providers from Romania, with whom we put contractual arrangements and security mechanisms in place to protect the data and to comply with our data protection, confidentiality and security standards, according with the EU legal requirements, including without limitation to Regulation (EU) 2016/679 (commonly known as “GDPR”).

The data that We collect from you and process as a result of your use of the Services may be transferred to a destination outside the European Economic Area ("EEA") as a result of our collaboration with third-party email marketing providers. By submitting your personal data, you agree to this transfer, storing or processing.

If we collaborate with such third-party providers, a Data Processor Agreement will be signed between Brainspotting Consulting S.R.L. and each of its data processors. These Data Processor Agreements are designed to help safeguard your privacy rights and give you remedies in the unlikely event of a misuse of your personal data.

We will not otherwise transfer your personal data outside of the EU or to any organisation (or subordinate bodies) governed by public international law or which is set up under any agreement between two or more countries.

Consequences of not providing your personal information to us

Your personal information is necessary so that Talentspotting can supply you with the services you are requesting or being interested in. If you choose not to provide your personal information that is mandatory to process your request, then you may not be able to create an account to sign up to our database and also, we may not be able to provide the corresponding Talentspotting services.

Do we do automated decision-making or profiling ?

We process your personal data for this purpose only on the basis of the explicit consent provided. We inform you that you have the right not to be subject to a decision based exclusively on automatic processing, including the creation of profiles, as well as the fact that this processing is not based on special categories of personal data.

Talentspotting processes your data in order to create profiles, to analyze or make predictions regarding your experience in order to be able to propose you the jobs suitable for your profile or for recommendation according to your professional skills.

To this end, Talentspotting ensures a fair and transparent processing, by using appropriate mathematical and statistical procedures for the creation of profiles, by implementing appropriate technical and organizational measures to ensure a minimum reduction of the risk of errors, as well as to ensure your personal data in a way that takes into account the potential dangers to your interests and rights.

RESPONSIBILITY

As grounded in GDPR, we take responsibility for:

  • In respect of the personal data of business contacts and prospects of Talentspotting, the Data Controller is Brainspotting Consulting S.R.L.;
  • In respect of the personal data of candidates who apply for, or who a Customer of Talentspotting contacts in respect of, a Job (as the term is described in Talentspotting’s Terms) (“Candidates”) Talentspotting shall process personal information as a Data Processor on behalf of its Customers, who use Our Services to assist with their recruitment processes. Where you apply for a role with one of Talentspotting’s Customers, our Customer’s privacy policy, rather than this Privacy Policy, will apply to our processing of your personal information.

In other words, if you visit our website or come into contact with us without having registered an account on Talentspotting, in your capacity as prospective Candidate or Customer or Recommender or Supplier, we bear full responsibility for your personal data.

However, if you visit our website or come into contact with us after having registered an account on Talentspotting, different conditions apply. As customers (“Customers”) of Talentspotting, companies create their own recommendation platform on the Website and invite you to register on the platform as a Recommender or a Candidate, within a Private User Area. Once you have registered and logged in, you are using the Customer’s recommendation platform. In this context, Talentspotting is acting only as a service provider commissioned by the Customer, doing what is called contract data processing.

What are your data protection rights?

Under the General Data Protection Regulation, you have a number of important rights free of charge. The data protection rights that apply in your case depend on the legal grounds and scope of processing your personal information.

  1. Right to be informed: You have the right to be informed about the collection and use of your personal data by Talentspotting. We provide you the relevant privacy information through this Privacy Policy. We want to have a trust relationship with you, that is why we want to be fully transparent with you regarding the use of your personal information. This right applies in all cases. If you have additional questions about how we collect and use your personal information, please contact Us.
  2. Right to object : You have the right to object to Talentspotting processing your data even if it is based on our legitimate interests, the exercise of official authority, direct marketing, and processing for the purpose of statistics. You have the right to object to processing your personal information in the following cases: Talentspotting processes your personal information based on legitimate interests or the performance of a task in the public interest/exercise of official authority (including profiling); direct marketing (including profiling); processing for purposes of scientific/historical research and statistics.

    If we are using your data because we deem it necessary for our legitimate interests to do so or for direct marketing, and you do not agree, you have the right to object. We will respond to your request within 30 days (although we may be allowed to extend this period in certain cases). Generally, we will only disagree with you if certain limited conditions apply.

Right to withdraw consent : Where we have obtained your consent to process your personal data for certain activities (for example, for profiling your suitability for certain roles), or consent to market to you, you may withdraw your consent at any time and for free. We will discontinue using your personal information unless there is an alternative ground to justify processing your data further, which you will be informed of.
  4. Data Subject Access Requests (DSAR) : You have the right to ask us to confirm what information we hold about you at any time, and you may modify, update or Delete any such information yourself from your Talentspotting account.
  5. Right to correct your personal information : In case your personal information that We hold and process is incomplete or inaccurate, you have the right to ask Ss to complete and/or rectify it, including by means of providing a supplementary statement. In case your personal information that is inaccurate or incomplete has been shared with another party, then we will ask this party to complete and rectify it as well. This right applies in all cases.
  6. Your right to restrict the use of your personal information: You have the right to restrict the processing of personal data in certain circumstances. This means that you can limit the way we use your data, which is an alternative to requesting the erasure of your data. We are permitted to store the data but not further process it. This right applies only in certain circumstances, it is not absolute. You have the right to request us restrict the processing of your personal data: if you contest the accuracy of your personal data and we are verifying the accuracy of the data; the data has been unlawfully processed and you oppose erasure and request restriction instead; we no longer need the personal data but you need us to keep it in order to establish, exercise or defend a legal claim; you have objected to us processing your data and we are considering whether our legitimate grounds override yours.

Right to erasure (”the right to be forgotten”) : In certain situations (for example, if the personal data is no longer necessary to Us for the purpose which was collected; if you withdraw your consent, in case the legal base for processing is your consent; if you object to processing your personal information for direct marketing purposes; in case your personal information is processed unlawfully; in case We must comply with a legal obligation), you have the right to request us to "erase" your personal data. We will respond to your request within 30 days (although we may be allowed to extend this period in certain cases) and will only disagree with you if certain limited conditions apply. If we do agree to your request, we will Delete your data but will generally assume that you would prefer us to keep a note of your name on our register of individuals who would prefer not to be contacted. That way, we will minimise the chances of you being contacted in the future where your data are collected in unconnected circumstances. If you would prefer us not to do this, you are free to say so.

Right of data portability : receive the personal data concerning you which you have provided to Us, in a structured, commonly used and machine-readable format and have the right to transmit that data to a third party in certain situations. This right allows you to obtain and reuse your personal information for your own purposes across different services. This means that you can move, copy or transfer personal data easily from one IT environment to another in a safe and secure way, without hindrance to usability. This right applies only to the personal information you provided to Us directly, where the processing is based on your consent or for the performance of a contract or when processing is carried out by automated means.
  9. Right to lodge a complaint with a supervisory authority : You also have the right to lodge a complaint with your local supervisory authority.

  • let Us know the information to which your request relates.

How can you lodge a complaint?

Having the created account and implicit the sub-domain of the company (example: companyname.talentspotting.com) following the corresponding steps, the 14 days trial period starts; during this period of time, you have access to all functionalities of the platform and implicitly you may proceed to personalizing and configuring the newly created platform (company data, online presence, terms and conditions, confidentiality policy, personalization of the e-mail contents, branding personalization etc.). Also, during the trial period, you may create and/or add new users (either by creating an individual account for any role wanted by the administrator or by users loading or even the sharing of a job to a friend, by e-mail or loading a CV in the platform).

Talentspotting does not assume any liability with regard to processing of the personal data made by oy on the basis of the account/fields created by you. For this purpose, we recommend you to use your own confidentiality policy/applicable terms and conditions in connection with processing of personal date of your users (notwithstanding their position: candidate, recommender, recruiter, etc.). The own policies applicable to your company may be loaded in the created account, in ”Settings” – ”Company” – ”Terms&Conditions”. For more information, please consult ”RESPONSABILITY” section from ”Privacy Policy”.

Upon the 14 days trial period, if you proceed to purchasing one of the standard packages put at disposal by Talentspotting, your demo account shall be automatedly converted to a paid account. If not, upon the expiry of the 14 days term, the entire personal data provided as a result of creating the account and the created company data, the account created by means of the platform (notwithstanding the modality in which the users accounts have been added/created) shall be anonymized by Talentspotting.

Also, during the trial period, you may create and/or add new users (either by creating an individual account for any role wanted by the administrator or by users loading or even the sharing of a job to a friend, by e-mail or loading a CV in the platform).

Talentspotting does not assume any liability with regard to processing of the personal data made by oy on the basis of the account/fields created by you. For this purpose, we recommend you to use your own confidentiality policy/applicable terms and conditions in connection with processing of personal date of your users (notwithstanding their position: candidate, recommender, recruiter, etc.). The own policies applicable to your company may be loaded in the created account, in ”Settings” – ”Company” – ”Terms&Conditions”. For more information, please consult ”RESPONSABILITY” section from ”Privacy Policy”.

Upon the 14 days trial period, if you proceed to purchasing one of the standard packages put at disposal by Talentspotting, your demo account shall be automatedly converted to a paid account. If not, upon the expiry of the 14 days term, the entire personal data provided as a result of creating the account and the created company data, the account created by means of the platform (notwithstanding the modality in which the users accounts have been added/created) shall be anonymized by Talentspotting.

Intrucat datele dumneavoastra personale sunt importante pentru noi si le tratam cu maxima seriozitate, ne angajam sa le protejam in conformitate cu legislatia aplicabila.

Beneficii, valabilitate cont demo creat

In vederea testarii serviciilor noastre, aveti posibilitatea de a va crea un cont de administrator (companie) prin accesarea link-ului de mai sus. Odata creat contul si implicit subdomeniul companiei (exemplu: numecompanie.talentspotting.com) prin parcurgerea pasilor aferenti, va incepe sa curga si perioada de testare de 14 zile, perioada in care veti avea acces la toate functionalitatile platformei si implicit veti putea proceda la personalizarea si configurarea platformei nou create (datele firmei, prezenta online, termeni si conditii, politica de confidentialitate, personalizare continut email, personalizare branding, etc.). Totodata, in perioada de testare, puteti crea si/sau adauga utilizatori noi (fie prin crearea unui cont individual pentru orice rol dorit de catre administrator, fie prin incarcarea de utilizatori sau chiar distribuirea unui job catre un prieten prin email sau prin incarcare CV in platforma).

Talentspotting nu isi asuma nicio raspundere cu privire la prelucrarea datelor cu caracter personal pe care o realizati in baza conturilor/domeniilor create de catre dvs. In acest scop, va recomandam sa utilizati propria politica de confidentialitate/termeni si conditii aplicabile in raport de prelucrarea datelor personale ale utilizatorilor dvs. (indiferent de functia detinuta de catre acestia: candidate, recommender, recruiter, etc.). Propriile politici aplicabile companiei dvs. pot fi incarcate in contul creat, in cadrul sectiunii ”Settings” – ”Company” – ”Terms&Conditions”. Pentru mai multe informatii, va rugam sa consultati sectiunea ”RESPONSABILITY” din cadrul ”Privacy Policy”.

La expirarea perioadei de trial de 14 zile, in situatia in care veti proceda la achizitionarea unuia dintre pachetele standard puse la dispozitie de catre Talentspotting, contul dvs. demo va fi convertit automat intr-un cont platit. In caz contrar, la expirarea termenului de 14 zile, toate datele cu caracter personal furnizate prin crearea contul si implicit datele companiei create, conturile create prin intermediul platformei (indiferent de modalitatea in care conturile de utilizatori au fost adaugate/create) vor fi anonimizate de catre Talentspotting.
